Terms and Conditions of Sale – Nellyani Paints

This page (together with the website legal notices and the Privacy Policy) tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products (Products) listed on www.nellyanipaints.com to you.

These Terms will apply to any contract between us for the sale of goods to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any Products from our site. Please note that by ordering any of our Products, you agree to be bound by these Terms and the other documents expressly referred to in it.

You Accept these Terms if you engage on or purchase any product from us. If you refuse to accept these Terms, you will not be able to order any Products from us. You should print a copy of these Terms or save them to your computer for future reference.

We amend these Terms from time to time as set out in clause 11. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated in May 2021.

These Terms, and any Contract between us, are only in the English language.

GENERAL

a. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or informational materials.

b. The Company: Nellyani Paints, registered and operating in Nigeria.

c. In purchasing from Nellyani Paints, customers confirm that they are eligible to do so. The Company may require customers to provide proof of eligibility.

d. These Terms apply to all purchases made through the official Nellyani Paints website or authorized distributors.

e. Any claims which are deemed to be outside of the nature of the sale or suspected fraudulent claims will be reviewed, and the Company reserves the right to take further action.

f. No third-party or joint submissions will be accepted.

g. The Company reserves the right, with or without cause, to exclude any person from purchases or withhold any order where there has been a violation of these Terms and Conditions.

h. All decisions are at the Company’s absolute discretion. In the event of a dispute, the decision of the Company is final, and no correspondence will be entered into.

i. If, for any reason, any aspect of the purchase process is not capable of running as planned, including by reason of computer virus, network failure, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Company, the Company may in its sole discretion modify or suspend the purchase process.

j. To the fullest extent permitted by law, the Company excludes:

  • a. All conditions, warranties and other terms which might otherwise be implied; and

  • b. Any liability for any direct, indirect or consequential loss or damage incurred by any customer in connection with a purchase. This shall not be deemed to exclude or restrict liability for death or personal injury resulting from the negligence of the Company or its employees.

k. Data protection: The Company is committed to protecting the privacy of customers. Any information collected in connection with a purchase will only be used by the Company or its agents for the purposes of marketing or administering the order.

l. These Terms are governed by and construed in accordance with the laws of Nigeria and are subject to the exclusive jurisdiction of the Nigerian courts.

a. If you are a consumer, you may only purchase Products from our site if you are at least 18 years old.
b. As a consumer, you have legal rights in relation to Products that are faulty or not as described. Nothing in these Terms will affect these legal rights.

a. You confirm that you have authority to bind any business on whose behalf you use our site to purchase Products.
b. These Terms and any documents referred to in them constitute the entire agreement between you and us.

6. Purchasing Products

a. After you place an order, you will receive an email acknowledging that we have received your order detailing the Products ordered and giving an estimated date for delivery. However, this does not mean that your order has been accepted.

b. We will confirm our acceptance by sending you an email that confirms that the Products have been dispatched (Dispatch Confirmation). The Contract between us and you will only be formed when we send you the Dispatch Confirmation.

c. If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available, we will inform you of this by email and will not process your order. If you have already paid for the Products, we will refund you the full amount as soon as possible.

a. The images of the Products on the website are for illustrative purposes only.

b. We have made every effort to display the colours of the Products as accurately as possible. However, we cannot guarantee an exact colour match due to screen variations.

c. We recommend that you use a colour tester on the actual surface before painting.

d. The packaging of the Products may vary from that shown on the site.

e. All Products are subject to availability.

8. Delivery

Products will be delivered to the address you provide during checkout. Delivery timelines will be communicated in your Dispatch Confirmation.

9. Price

a. The prices of the Products will be quoted on our site from time to time. We take all reasonable care to ensure accuracy.

b. Prices for our Products may change, but changes will not affect any order already confirmed.

c. The price of a Product does not include delivery charges. Delivery charges will be provided at checkout.
